In her application, Ms. Ottley argues that NYCHA`s determination was unfair, because while she was ill, due to her breast cancer and the side effects of her chemotherapy treatments, as well as post-traumatic stress and depression, she was often inconsistent and did not know what was going on, including the criminal activities that were taking place in his apartment. She says she slept most of the time in her room and was often treated with a lot of medication, which made her very weak and sleepy. As for her son`s presence in the apartment, she admits that she asked him to come to the apartment to help him with his daily activities in the apartment, as she could not do much for herself, while being weakened and treated with medication. She also asserts, and it is indisputable, that NYCHA never removed her son from the lease and therefore assumed that he was still a licensed tenant. He also invokes the rejection of the criminal complaints lodged against her, resulting from the search of their home on 30 March 2007, and the decision of the Public Prosecutor`s Office not to prosecute the criminal charges brought against her during the search of the dwelling on 2 November 2007, as a basis for favourable relief. Ms. Ottley found that her son had not been in the apartment for about a year when the hearing took place.
